AKAD NIKAH PENYANDANG DISABILITAS FISIK DI YOGYAKARTA PERSPEKTIF HUKUM ISLAM

Abstract

Persons with physical disabilities in the form of limitations in speech / speech impairment are people who cannot speak like normal people in general. Thus, the person cannot pronounce the marriage contract clearly. However, in the provisions of Islamic law, the pronunciation of the consent of the qabul must be clear. The research method used is field research. The nature of this research is descriptive analytic, namely describing, recording, analyzing, and interpreting conditions that are currently occurring or exist. Data collection techniques in this study were interviews and documentation. Normative and juridical approaches. Deductive and Inductive Methods. When the groom performs kabul it is carried out according to the bride's abilities. This was carried out in two ways, first, by using sign language that he understood and his signs could be understood by the witnesses and secondly, by using the representation of another person. Then in the reality that happened in KUA throughout Yogyakarta, his response was assisted by a spokesperson, one of which was his own older brother. According to Islamic law it is legal or permissible because it is in accordance with Islamic law.
